The Board of Supervisor met in Session on the above date with the following members present: Condon, Dencklau, Lizer, Motl and Nolting.   Absent:  None.

Moved by Condon, seconded by Dencklau to approve minutes of July 8, 2008, regular meeting.  Motion carried unanimously.

Moved by Dencklau, seconded by Motl to receive and place on file Drainage Repairs in D.D.#4 Webster and #272 Hamilton Counties Iowa.  Motion carried unanimously.

Moved by Motl, seconded by Nolting to approve salary increases for Sheriff Deputies Joe Paullin and April Murray to $41,023.66, effective July 9, 2008; and Sheriff Deputy Darren Robinson to $41,023.66, effective July17, 2008.  Motion carried unanimously.

Moved by Nolting, seconded by Condon to approve employment of Jenna Wohlers Part-time Jailer at the rate of $10.61 per hour, effective July 9, 2008.  Motion carried unanimously.

Moved by Condon, seconded by Dencklau to approve employment of Hillary Lenz, Clerk in Auditor’s office, at the rate of $11.10, effective July 28, 2008.  Motion carried unanimously.

Moved by Dencklau, seconded by Motl to approve Purchase Agreement for permanent easements for a trail from Kennedy Park to Harlan Rogers Sports Complex.  (Copy on file in Auditor’s office).  Motion carried unanimously.

Moved by Motl, seconded by Nolting to approve transfer of unexpended fiscal year 2007-2008 balance of $9,19580 from the General Basic Fund to Conservation Trust Fund.  Motion carried unanimously.

Moved by Nolting, seconded by Condon to receive and place on file Manure Management Plans for Oak Lane l, in Section 4, Dayton Township.  (Copies on file in Auditor’s office).  Motion carried unanimously.

Moved by Condon, seconded by Dencklau to adopt the following Resolution:

RESOLUTION

Whereas, the State of Iowa has appropriated moneys for fiscal year July 1, 2008 through June 30, 2009, which moneys are insufficient to fully fund the various local property tax credits/exemptions,

And, whereas, Iowa Code Section 25B.7 requires local governments to extend to the taxpayers only those portions of the property tax credits/exemptions that are estimated by the Iowa Department of Revenue and Finance to be funded by the sate appropriation,

And, whereas the Iowa Department of Revenue and Finance has estimated the percentages of funding for the affected property tax credits/exemptions as follows:  Homestead credit (including Disabled Veteran’s Homestead Credit) 72%, Low-income, Elderly, Disabled Credit 100%, Military Exemption 100%,

And, whereas the option of fully funding property tax credits/exemptions will cause a funding shortfall to local governments in the County, this fiscal year,

And, whereas the option of passing on the reduced state-reimbursed values of the credits will increase the amount of net taxes in the County,

And, whereas we find that passing on the reduced state-reimbursed values of the homestead credits to the taxpayers in the County funds local governments to the greatest effect while impacting the largest number of persons with minimal effect and, therefore, in the public interest,

Now, therefore, be it resolved pursuant to Iowa Code Section 25B.7 that the property tax credits/exemptions in Webster County for fiscal year July 1, 2008 through June 30, 2009 shall be funded as follows:

 

Homestead Credit 72%
Low-Income, Elderly, Disabled Credit 100%
Military Exemption 100%

Moved by Dencklau, seconded by Motl to approve and authorize Chair to sign Agreement between Webster County Board of Supervisors, Webster County Board of Health and North Central Home Care, Inc. to facilitate Iowa Public Health Grant Funds. (Copy on file in Auditor’s office).  Motion carried unanimously.

Moved by Motl, seconded by Nolting to approve abatement of Mobile Home Taxes on Parcel #01000-22GES3746, for 2005, 2006, and 2007 tax years, in the total amount of $404.00.  Motion carried unanimously.

Moved by Nolting, seconded by Condon to approve and authorize Chair to sign utility permit applications from Prairie Energy Cooperative to bury secondary electric cable across road at 2326 and 2460 Brushy Creek road between Sections 10 and 11, Washington Township. (Copy on file in Engineer’s office).  Motion carried unanimously.

Moved by Condon, seconded by Dencklau to approve and authorize Chair to sign resolution for temporary road closure of Route P29 (a.k.a. Baxter Avenue) at railroad crossing immediately south of Highway 20 and designate detour route to remove railroad crossing material from abandoned rail line and place hot mix asphalt patch.  Motion carried unanimously.
