The Board of Supervisor met in Session on the above date with the following members present: O’Farrell, Magnusson, Kirkberg, Peterson and Chairperson Martin. Absent none.
Moved by Kirkberg, seconded by Magnusson to approve minutes of meeting September 5, 2000. Motion carried unanimously.
A Public Hearing on final consideration of Ordinance No. 029: Ordinance Imposing a Local Option Sales and Service Tax Applicable to Transactions within Webster County was held. No objections being heard it was moved by Magnusson, seconded by O’Farrell to approve final consideration and adopt the following Ordinance:
WEBSTER COUNTY ORDDINANCE NO. 29.
AN ORDINANCE IMPOSING A LOCAL OPTION SALES AND SERVICE TAX APPLICABLE TO TRANSACTIONS WITHIN WEBSTER COUNTY IOWA
WHEREAS a Local Option Sales and Service Tax has been approved by voters in all the incorporated and non-incorporated portions of Webster County
BE IT ENACTED BY THE BOARD OF SUPERVISORS OF WEBSTER COUNTY IOWA:
Section 1. Local Option Sales and Service Tax. There is hereby imposed a local option sales and service tax applicable to transactions within Webster County.
The rate of the tax shall be one-half (1/2) percent upon the gross receipts taxed pursuant to Local Option Sales Tax provisions of Chapter 422B of the Code of Iowa in Webster County.
The local option sales tax is imposed on transactions occurring on and after January 1, 2001 anywhere in Webster County. All persons required to collect state gross receipt taxes shall collect the tax. However, the tax shall not be imposed on the gross receipts from the sale of motor fuel or special fuel as defined in Chapter 324 of the Code of Iowa, on gross receipts for the rental of rooms, apartments or sleeping quarters which are taxed under Chapter 422A of the Code of Iowa during the period the hotel or motel tax is imposed, on gross receipts from the sale of natural gas or electric energy in a city or in the county when the gross receipts are subject to a franchise fee or user fee during the period the franchise or user fee is imposed, on the gross receipts from the sale of a lottery ticket or share in a lottery game conducted pursuant Chapter 99E of the Code of Iowa, and on the sale or rental of tangible personal property described in Section 422.45, Subsections 26 and 27 of the Code of Iowa.
All applicable provisions of the appropriated Sections of Chapter 422, Divisions IV, of the Code of Iowa are adopted by reference.
Section 2. Effective Date. This Ordinance shall go into effect on January 1, 2001.
Section 3. Expiration Date. This Ordinance shall expire on June 30, 2009, unless sooner vacated as provided by law.

Moved by O’Farrell, seconded by Peterson to approve and authorize Chair to sign MH/MR/DD Provider Contract with Sioux Valley Regional Health Services d/b/a Northwest Iowa Health Center and Addendum of Contract with Plymouth Life Incorporated. (Copies on file in CPC’s Office). Motion carried unanimously.
Moved by Peterson, seconded by Kirkberg to approve and authorize Chair to sign Utility Permit Application for City of Fort Dodge to construct sanitary sewer line, west side of Nelson Avenue from Army Reserve Building north to the North edge of the Certified Transmission Building; line to be bored under County Road D-14 on west side of Nelson Avenue. Motion carried unanimously.
At 10:30a.m. a Public Hearing on second consideration of the adoption of Ordinance Number 31; Ordinance Establishing the Area Service “C” Road Classification in Webster County, Iowa, was held. Comments were heard by Dave Jordison and Pete Finnigan regarding the closure of said roads. County Engineer Robert Sperry addressed their concerns and assured Mr. Jordison that it would take a petition signed by all landowners affected to accomplish such a road classification change. Following comments, it was moved by Kirkberg, seconded by Magnusson to approve second consideration of said Ordinance 031 and further to set October 10, 2000 at 10:30a.m. as the time and date for final consideration of said Ordinance. Roll call vote: Ayes – Kirkberg, Magnusson, O’Farrell, Peterson and Martin. Nays – None. Motion carried unanimously.
A public bid letting was held at 10:45a.m. to receive and open bids for projects L-880494--73-94 and L-600204—73-94 Bridge Replacements and grading in Pleasant Valley and Gowrie Townships. Moved by Magnusson, seconded by O’Farrell to accept the low bid submitted by Merryman Bridge Construction in the amount of $94,534.70 for said bridge replacements and grading projects and to further authorize the Chair to sign the contract documents at the appropriate time. Motion carried unanimously.
Moved by O’Farrell, seconded by Kirkberg to allow claims. Motion carried unanimously.
