Regular Meeting

December 16, 2003

 

The Board of Supervisor met in Session on the above date with the following members present:  Magnusson, Peterson, Condon, Gill, and Nolting.  

 

At 8:30a.m. the Chairman called to order the Canvass of the  December 9, 2003 Special Election to fill vacancy of County Sheriff.  Moved by Magnusson, seconded by Condon to accept the following as the official canvass of said special election: 

 James V. Stubbs                  1526 votes

                 Brian W. Mickelson            3117 votes

 

Motion carried unanimously.

 

Brian Mickelson was sworn in as Webster County Sheriff by the Honorable Judge Cady.

 

Moved by Magnusson, seconded by Condon to approve minutes of December 9, 2003 meeting.  Motion carried unanimously.

 

Moved by Condon, seconded by Gill to receive and place on file Drainage Repairs in D.D.#57.  Motion carried unanimously.

 

Moved Gill, seconded by Nolting to accept resignation of Deb Raymond, Webster County Mental Health Advocate, effective December 31, 2003.  Motion carried unanimously.

 

Moved by Nolting, seconded by Magnusson to receive and place on file resignation of Alan Croomquist, Fulton Township Clerk, effective December 6, 2003 and appointment of Gordon Chalstrom to fill vacancy as approve by the Fulton Township Trustees.  Motion carried unanimously.

 

Moved by Magnusson, seconded by Condon to receive and place on file salary increases for Child Support Recovery Unit as follows and recommended by State office of Child Support Recovery, effective December 22, 2003:  LaVonne Pringle to $1,125.40 every two weeks and Nannette Slawson to $1,311.77 every two weeks.  Motion carried unanimously.

 

Moved by Condon, seconded by Gill to receive and place on file Manure Management Plan update for D. Craig Gascho in Section 10, Badger Township.  (Copy on file in Auditor’s office).  Motion carried unanimously.

 

Moved by Gill, seconded by Nolting to approve and authorize Chair to sign permit application from four property owners for construction of 12-inch and 18-inch sub-drain crossings between Section 34, Roland Township and Section 3, Gowrie Township.  (Copy on file in Engineer’s office).  Motion carried unanimously.

 

Moved by Nolting, seconded by Magnusson to receive and place on file resignation of Danny Ferry, Class C Equipment Operator, in Secondary Road Department, effective December 31, 2003.  Motion carried unanimously.

 

Moved by Magnusson, seconded by Condon to approve and authorize Chair to sign permit application from Litchfield Realty Company to outlet private field drainage tile into the north road right-of-way of Route D54 approximately 1320 feet east of the Southwest Corner of Section 27, Yell Township.  (Copy on file in Engineer’s office).  Motion carried unanimously.

 

At 10:30a.m. a Public Hearing was held on the first consideration to amend Zoning Ordinance 024, to permit non-farm single family dwellings in Agricultural (A-1) districts on two acres of land if parcel’s Corn Suitability Rating (as defined by the Soil Conservation Service) is 65 or less; to permit home occupation signs in Agricultural districts; list sign permitted in all districts; and to change violations from misdemeanors to county infractions.  Written objection was filed by the City of Fort Dodge, Iowa objecting to permitting non-farm single family dwellings in Agricultural (A-l) districts on two acres of land if CSR rating is 65 or less.  Objection to same was orally presented by Ernie Kersten with concern of Webster County’s gypsum deposits and potential land conflicts if such was permitted.

 

Moved by Gill, seconded by Nolting to refer amendment of Article Five of Webster County Zoning Ordinance 024, to permit non-farm single family dwellings in Agricultural (A-1) districts on two acres of land if parcel’s Corn Suitability Rating (as defined by the Soil Conservation Service) is 65 or less back to the Planning and Zoning Commission. Roll call vote:  Ayes – Peterson, Magnusson, Condon, Gill and Nolting.  Nayes – None.  Motion carried unanimously.

 

Moved by Nolting, seconded by Magnusson to approve first consideration to amendment of Article 13 or Webster County Zoning Ordinance 024, to permit home occupation signs in Agricultural districts; list sign permitted in all districts; and further to waive second consideration and set January 13, 2004 at 10:30a.m. as the time and date for hearing on final consideration of said amendment.  Roll call vote:  Ayes – Peterson, Magnusson, Condon, Gill and Nolting.  Nayes – None.  Motion carried unanimously.

 

Moved by Magnusson, seconded by Condon to approve first consideration to amendment of Article 17 of Webster County Zoning Ordinance 024, to change violations from misdemeanors to county infractions; and further to waive second consideration and set January 13, 2004 at 10:30a.m. as the time and date for hearing on final consideration of said amendment.  Roll call vote:  Ayes – Peterson, Magnusson, Condon, Gill and Nolting.  Nayes – None.  Motion carried unanimously.

 

The Webster County Library Association requested the same level of funding for their libraries as in the current year or as close to it as possible for fiscal year 2004-2005.  No action taken.   

 

Moved by Condon, seconded by Gill to allow claims.  Motion carried unanimously.
