Regular Meeting

September 26, 2006

 

The Board of Supervisor met in Session on the above date with the following members present: Condon, Gill, Nolting and Lizer. Absent: Magnusson

 

Moved by Lizer, seconded by Gill to approve minutes of September 19, 2006 regular meeting and the Special Meeting of September 25, 2006 to canvass Merged Area V Community College Election held on September 12, 2006.  Motion carried unanimously.

 

Moved by Gill, seconded by Condon to receive and place on file Manure Management Update for M & K Management, in Section 18, Burnside Township.  (Copy on file in Auditor’s office).  Motion carried unanimously.

 

Moved by Condon, seconded by Lizer to approve and authorize Chair to sign amendment to copier lease agreements for MIS Department and County Attorney’s office.  (Copy on file in Auditor’s office).  Motion carried unanimously.

 

Moved by Lizer, seconded by Gill to approve resolution to temporarily close McGuire Bend Road from the junction of Sara Avenue and 320th Street to the junction of Vasse Avenue and 320th Street due to road slide adjacent to Des Moines River.  Motion carried unanimously.

 

Moved by Gill, seconded by Condon to approve and authorize Chair to sign utility permit application from Kevin Peterson to construct sub-drain between Sections 17 and 18, Clay Township approximately 100 feet south of the west quarter corner of said Section 17.  (Copy on file in Engineer’s office).  Motion carried unanimously.

 

Moved by Condon, seconded by Lizer to adopt the following resolution:

 

RESOLUTION

 

WHEREAS, the Webster County Board of Supervisors is empowered under the authority of Sections 321.255 and 321.285 of the Code of Iowa, to determine upon the basis of an engineering and traffic investigation, that the speed limit of any secondary road is greater than is reasonable and proper under the conditions existing, and may determine and declare a reasonable and proper speed limit, and

 

WHEREAS, such an engineering and traffic investigation has been completed by the Webster County Engineer.

 

NOW, THEREFORE, BE IT RESOLVED by the Webster County Board of Supervisors that the speed limit be established and appropriate signs be erected at the location described as follows:

 

·         40 MPH along Route P33 at Gowrie from 700 Feet south of 355th Street to 100 feet

North of 355th Street; and

·         25 MPH along Rout P33 at Gowrie from 100 feet North of 355th street to 100 feet

North of Route D60/Main Street; and

·         40 MPH along Route P33 at Gowrie from 100 feet north of Route D60/Main Street to

900 feet north of Route D60/Main Street

 

This speed limit shall be effective when the traffic control signs are erected.

Moved by Lizer, seconded by Condon to adopt the following resolution:

 

RESOLUTION

 

WHEREAS, there now exists a 28E Agreement known as the Mid Iowa Safety Alliance which is made up of numerous counties and cities within North Central Iowa, and

 

WHEREAS, the below named municipality desires to dissolve the 28E Agreement dated the 13th day of March, 2000 creating Mid Iowa safety Alliance.

 

WHEREAS, the original 28E Agreement dated the 13th day of March, 2000, provided for its amendment from time to time with approval of the majority of the body membership of the Mid Iowa Safety Alliance,

 

WHEREAS, the original 28E Agreement dated to 13th day of March, 2000, provided for dissolution of the 28E agreement upon a vote of 75% of the membership supporting such action,

 

NOW, THEREFORE, BE IT RESOLVED the Webster County Supervisors authorize the Chairman of the Board of Supervisors to sign the Resolution for this political subdivision to agree to the dissolution.

A General Relief Appeal Hearing was scheduled for 10:30a.m.  However after a fifteen-minute wait, the appellant did not show and County Attorney advised the Board that the General Relief Director’s decision is upheld.
