Board of Supervisiors Meeting
Tuesday April 24, 2012

The Board of Supervisors met in Session on the above date with the following members present:  Dencklau, Singer, Peterson, Condon and Fletcher.   Absent:  None.

Moved by Peterson, seconded by Condon to approve minutes of the April 17, 2012 regular meeting. Motion carried unanimously.

Moved by Condon, seconded by Fletcher to receive and place on file the following Drainage Repairs:  D.D.#4 Lateral 5; D.D.#70 Webster and #95 Calhoun; and D.D.#247 Webster and #7 Humboldt.  Motion carried unanimously.

Moved by Fletcher, seconded by Dencklau to receive and place on file County Recorder’s Report of Fees Collected for period ending March 31, 2012.  (Copy on file in Auditor’s office).  Motion carried unanimously.

Moved by Dencklau, seconded by Peterson to receive and place on file General Assistance Quarterly Report of Persons Served and Veteran Assistance Quarterly Report of Persons Served for period ending March 31, 2012.  (Copies on file in Auditor’s office).  Motion carried unanimously.

Moved by Peterson, seconded by Condon to approve Beer Permit Application Renewal for Fort Dodge Air National Guard Service Club, pending Dram Shop Endorsement.  Motion carried unanimously.

Moved by Condon, seconded by Fletcher to adopt the following resolution:

         WHEREAS, the Webster County Board of Supervisors on the 2nd day of November,2010 did enter into a contract with Jensen Builders, Inc. for the 2010 Law Enforcement Center Remodel Project, and on the 28th day of February, 2011 did enter into a contract with Jensen Builders, Inc. for the Webster County Law Enforcement Center Mechanical Upgrades project, and
         WHEREAS, the Webster County Board of Supervisors has received a letter dated April 17, 2012, from  Haila Architecture stating that the 2010 law Enforcement Center Remodel and the Webster County Law Enforcement Center Mechanical Upgrades Project are now fully completed, and
         WHEREAS, it is the recommendation of the Architect that the Board of Supervisors accepts the 2010 Law Enforcement Center Remodel and the Law Enforcement Mechanical Upgrades Project as being fully complete and establish the date of  acceptance of its completion, and
         WHEREAS, upon acceptance of the above named projects ninety-five percent (95%) of the contract amounts can be paid to the contractor, while five percent (5%) will be required to be retained until the expiration of thirty-one (31) days after this date of acceptance, and
         WHEREAS, in the event any subcontractor and/or supplier involved with said projects has reason to file a claim, the retained can be used to pay for the contested amount.
         THEREFORE BE IT HEREBY RESOLVED that the Webster County Board of Supervisors hereby accepts the 2010 Law Enforcement Center Remodel and the Law Enforcement Mechanical Upgrades Projects as being fully complete and establishes the date of acceptance of its completions of this the 24th day of April, 2012.

Moved by Fletcher, seconded by Dencklau to approve the following 2011 Tax Exempt Status for Wildlife Habitat under Slough Bill enacted in1982 and further to approve the following applications for open prairie, rivers and streams, forest cover, recreation lakes and residential wildlife habitat as exempt property per Board Resolution on April 12, 1983; and receive and place on file Native Prairie tax exemptions:

Motion carried unanimously.

At the April 3, 2012 Board meeting it was noted that only one Request For Proposals to Provide Legal Services to Webster County for FEMA Flood Buy Out Program was received; therefore the item was tabled and Requests For Proposals were once again sent to all Webster County Attorneys.  No further proposals being received, Chairman Singer opened the following proposal from Eric Eide, P.L.C.

Moved by Fletcher, seconded by Dencklau to approve proposal from Eric Eide, subject to determination from two other attorneys that this is a reasonable proposal.  Motion carried unanimously.

Following review of the one bid received in the amount of $4,500.00 submitted by Chris Dencklau for demolition/cleanup at 2457 Riverside Trail, per Dilapidated Building Ordinance, it was moved by Peterson, seconded by Condon to accept the proposal.  Supervisor Dencklau stated he would abstain from voting on this matter. Motion carried.

Moved by Condon, seconded by Fletcher to approve and authorize Chair to sign utility permit application from Frontier Communications to bury fiber optic cable along west side of Kansas Avenue in Section 22, Township 88 North, Range 29 West, Elkhorn Township.  (Copy on file in Engineer’s office).  Motion carried unanimously.

Moved by Fletcher, seconded by Dencklau to approve salary adjustment for Brian Henderson to $63,426.00 effective May 8, 2012, per Engineer’s office salary schedule.  Motion carried unanimously.

Moved by Dencklau, seconded by Peterson to allow claims. Motion carried unanimously.

Moved by Peterson, seconded by Condon to adjourn the meeting.  Motion carried unanimously.
