Board of Supervisiors Meeting
Tuesday May 8, 2012

The Board of Supervisors met in Session on the above date with the following members present:  Dencklau, Peterson, Condon and Fletcher.   Absent:  Singer.

Moved by Condon, seconded by Fletcher to approve minutes of the May 1, 2012 regular meeting.  Motion carried unanimously.

Moved by Fletcher, seconded by Dencklau to receive and place on file the following Drainage Repairs:  D.D. #57 Cooper Township Sec 1 and Joint D.D. #247 and Humboldt #7 Lat #1 Badger Sec 26.  Motion carried unanimously.

Moved by Dencklau, seconded by Condon to approve employment of Alison Hauser, Case Manager for Targeted Case Management Program, at the rate of $18.33 per hour, effective May 14, 2012. Motion carried unanimously.

Moved by Condon, seconded by Fletcher to approve and authorize Chair to sign Iowa Department of Human Services Community Mental Health Center Affiliation contracting with Berryhill Center for Mental Health.  Motion carried unanimously.

Moved by Fletcher, seconded by Dencklau to approve and authorize the sharing 2012 Byrne JAG Grant fund with the Webster County Sheriff’s office and Fort Dodge Police Department as follows: Fort Dodge Police Department - $8,103.00; Webster County Sheriff’s office - $8,103.00; and Joint Drug Task Force - $4,051.00. (Copy on file in Auditor’s office).  Motion carried unanimously.

Moved by Dencklau, seconded by Condon to approve and authorize Chair to sign Inter-Local Agreement between City of Fort Dodge and County of Webster, Iowa for 2012 Byrne Justice Assistance Grant (JAG) Program Award.

This agreement is made and entered into this 1st day of May 2012, by and between the COUNTY of WEBSTER acting by and through its governing body, the Board of Supervisors, hereinafter referred to as the COUNTY,  and the CITY of FORT DODGE, acting by and through its governing body, the City Council, hereinafter referred to as the CITY, both of WEBSTER County, State of  IOWA, witnesseth:

WHEREAS, each governing body, in performing governmental functions or in paying for the performance of governmental functions hereunder, shall make that performance or those payments from current revenues legally available to that party:   and

WHEREAS, each governing body finds that the performance of this agreement is in the best interests of both parties, that the undertaking will benefit the public, and that the division of costs fairly compensates the performing party for the services or functions under this agreement:   and

WHEREAS, the CITY and the COUNTY agree to share the grant funds equally:  and

WHEREAS, the CITY and COUNTY believe it to be in their best interests to reallocate the JAG funds.

NOW THEREFORE, the COUNTY and CITY agree as follows:

                                                                                                Section 1.
CITY and COUNTY agree to use all grant funds to purchase law enforcement equipment.  The grant funds shall be shared equally with the Fort Dodge Police Department, the Webster County Sheriff’s Office.  The Joint Drug Task Force operated by the Webster County Sheriff’s Office and the Fort Dodge Police Department shall receive 20% of the total award for equipment.

                                                                                                Section 2.
The CITY shall serve as the grant Fiscal Agent.

                                                                                                Section 3.
Nothing in the performance of this Agreement shall impose any liability for claims against COUNTY other than claims for which liability may be imposed by Iowa Tort Claims Law.

                                                                                                Section 4.
Nothing in the performance of this Agreement shall impose any liability for claims against CITY other than claims for which liability may be imposed by Iowa Tort Claims Law.

                                                                                                Section 5.
Each party to this agreement will be responsible for its own actions in providing services under this agreement and shall not be liable for any civil liability that may arise from the furnishing of services by the other party.

                                                                                                Section 6.
The parties to this Agreement do not intend for any third party to obtain aright by virtue of this Agreement.

                                                                                                Section 7.
By entering into this Agreement, the parties do not intend to create any obligations express or implied other that those set out herein; further, this Agreement shall not create any rights in any party not a signatory hereto.

Moved by Condon, seconded by Fletcher to approve letter requesting amendment to the Property Acquisition Project Application for the Webster County Flood Acquisition Program 2011. Motion carried unanimously.

Moved by Fletcher, seconded by Dencklau to approve and authorize Chair to sign utility permit application from Frontier Communications to bury fiber optic cable along south side of 150th Street and through conduit in new bridge deck in Section 34, Township 90 North, Range 28 West, Badger Township. (Copy on file in Engineer’s office).  Motion carried unanimously.

Moved by Dencklau, seconded by Condon to allow claims.  Motion carried unanimously.

Moved by Condon, seconded by Fletcher to adjourn the meeting.  Motion carried unanimously.
